Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) governs your use of the August Guest platform, operated by DDI AugustGuest LLC. It supplements our Terms of Service and applies to all customers, staff members, and anyone accessing the Service. Violations may result in immediate suspension or termination of your account without refund.

2. Prohibited Uses

Illegal Activity

• Using the Service for any purpose that violates federal, state, or local law
• Collecting or processing personal data in violation of applicable privacy laws
• Using the Service in connection with fraud, money laundering, or financial crime
• Violating any export control or sanctions regulations

SMS and Communications Abuse

• Sending marketing, promotional, or advertising content through queue notification SMS — queue SMS is strictly limited to transactional messages (e.g., “Your table is ready”)
• Sending SMS to guests who have not provided their phone number and consented to receive queue notifications
• Failing to honor opt-out (“STOP”) requests from guests
• Violating the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any applicable communications law

Platform Abuse

• Accessing or attempting to access another customer's account, data, or queue without authorization
• Using automated scripts, bots, or crawlers to interact with the Service beyond normal use
• Scraping, harvesting, or extracting data from the Service using automated tools
• Deliberately overloading or stress-testing the Service infrastructure without prior written consent
• Exploiting bugs, vulnerabilities, or unintended behaviors in the Service — instead, report them to hello@augustguest.com
• Attempting to bypass, circumvent, or defeat any rate limiting, authentication, or security controls
• Using the Service API (if available) beyond documented rate limits or in ways not described in the documentation

Impersonation and Misrepresentation

• Creating accounts that impersonate another business, individual, or entity
• Misrepresenting your identity, business type, or location during registration or use
• Creating multiple accounts to circumvent limits, suspensions, or pricing

Intellectual Property

• Reverse engineering, decompiling, or attempting to extract source code from the Service
• White-labeling or reselling the Service without written permission from August Guest
• Removing or altering August Guest branding, attribution, or proprietary notices
• Using August Guest's name, logo, or trademarks without prior written consent

Healthcare and Regulated Data

• Displaying Protected Health Information (PHI) on public-facing screens, kiosk displays, or TV displays
• Using the Service as a HIPAA-compliant system — August Guest does not offer BAAs and is not a HIPAA Business Associate
• Collecting or processing data subject to special regulatory requirements (medical records, financial data, children's data under COPPA) without appropriate safeguards

3. Content Standards

Any content you submit to the Service (business names, custom messages, quick-pick labels, event names, etc.) must not:

• Be defamatory, obscene, harassing, threatening, or offensive
• Infringe the intellectual property rights of any third party
• Contain malware, viruses, or malicious code
• Constitute spam or unsolicited advertising
• Violate the rights of privacy or publicity of any individual

4. Enforcement

August Guest reserves the right to investigate any suspected violation of this AUP. Upon finding a violation, August Guest may, at its sole discretion:

• Issue a warning
• Temporarily suspend your account
• Permanently terminate your account without notice and without refund for serious, repeated, or egregious violations
• Disclose information to law enforcement or regulatory authorities as required by law or to protect the rights of August Guest and its users
• Pursue legal remedies, including injunctive relief and monetary damages

August Guest's failure to enforce this AUP in any instance does not constitute a waiver of the right to enforce it in the future.

5. Reporting Violations

If you become aware of a violation of this AUP — including security vulnerabilities, abuse, or unauthorized use — please report it immediately to hello@augustguest.com. We take all reports seriously and will investigate promptly.
